Attorney General of Alabama Wins Battle Against Illegal Electronic Bingo Games

The Alabama Supreme Court ruled on September 10 in State v. Epic Tech to prohibit Victoryland, Southern Star, and White Hall Casinos from continuing their gaming activities. 

Alabama attorney general Steve Marshall, who has led this fight for several years, celebrated the long-awaited victory: “The Alabama Supreme Court’s opinion makes clear what the office has maintained from the beginning: these gambling enterprises are not only illegal under Alabama law, but also a threat to public health, morals, safety, and welfare.”

Marshall also noted that the state has gradually prevailed in all lawsuits against unlawful gaming practices in Alabama. Five counties have had their casinos ordered to suspend operations thus far.

In 2017, the attorney general’s office prevailed against the River City Casino in Morgan County; in 2018, the state prevailed against the Center Stage casino in Houston County; and the most recent court decision involves the Southern Star, White Hall, and Victoryland casinos in Lowndes and Macon counties, respectively. 

In accordance with the court’s ruling, the local circuit courts in the respective counties must issue injunctions prohibiting the provision of all electronic bingo games within 30 days.

Alabama has fought against illegal bingo games

The problem of unauthorized electronic bingo games has been prevalent for more than a decade. In 2009, judicial proceedings were initiated that resulted in a 2016 court judgment declaring that the bingo games offered by casinos in several Alabama counties do not conform to the definition of bingo game contained in state law. 

The Alabama Supreme Court ruled that electronic bingo games offered in casinos throughout Alabama’s counties resemble slot machines and are therefore illegal.

Another significant state victory against a gaming operator occurred at the start of July. Greentrack, a non-profit bingo operator, lost a case against the attorney general’s office and must now pay $76 million in uncollected taxes from illegal operations. 

The legal dispute lasted eleven years, with Greentrack prevailing in lower court processes but losing at the Alabama Supreme Court.
