Unlicensed horse racing betting apps have piqued the interest of New Hampshire officials, who claim that the use of one particular app has resulted in hundreds of thousands of dollars in revenue loss for their state. There are many gamblers who choose to place bets on horse racing that make use of the TwinSpires app.

TwinSpires does not adhere to state law

The executive director of the New Hampshire Lottery, Charlie McIntyre, spoke about the situation and stated that TwinSpires is not controlled by the lottery and does not function inside the legal framework of the state. He went on to say that the horse racing app operates in a gray area, and that this is a major source of concern for the state lottery system. According to McIntyre, all types of gambling in New Hampshire are regulated or licensed by the lottery, which is the state’s licensing and regulatory authority. TwinSpires’ situation is concerning because the lottery does not oversee the app and has not granted it a license.

Officials from New Hampshire’s attorney general’s office have confirmed that they are aware of the issue and that they will investigate the operator’s actions in the state. As stated by Attorney General John Formella, “the Department of Justice in the state takes all questions of illegal gambling in the state very seriously.” He also stated that he has been made aware of the problem and is currently conducting an investigation into it. According to reports, the New Hampshire Lottery attempted to work on an administrative rule change to include TwinSpires into its regulatory framework, but those efforts were unsuccessful.

Churchill Downs is the parent company of TwinSpires

Because the desired results were not reached, Churchill Downs, the parent company of TwinSpires, has declared that it will close down its online businesses within six months due to the fact that it did not achieve the desired results.

Churchill Downs’ chief executive, Bill Carstanjen, has indicated that the level of competition in the market is simply too high, and that this is preventing the organization from achieving its success goals. Interestingly enough, Churchill Downs encountered a similar difficulty with the TwinSpires app in Texas back in 2013.

In 2012, the Texas Racing Act was amended to include prohibitions on horse betting and greyhound betting, as well as other restrictions on gambling. Many companies offered their services to people of Texas just before the law was approved, and after the new laws were put into force, all operators with the exception of TwinSpires withdrew their services.

A lawsuit against the Texas Racing Commission resulted as a result of this, and Churchill Downs was named as a defendant. An appeals court decided against Churchill Downs, prompting the horse racing firm to declare that the Texas legislation violates the Commerce Clause of the United States Constitution, and that it will appeal the ruling.
