Nevada Approves Enhanced Gambling Regulations in Cybersecurity

The Nevada Gaming Commission has approved an enhanced regulation regarding cybersecurity.

After a vote on Thursday, the Nevada Gaming Commission unanimously approved an amendment to the state gambling regulations. 

As a result of this vote, casinos in the state of Nevada will be required to take measures to protect their customers, employees, and themselves from computer-based cyberattacks.

Establishing Risk Assessment Strategies in Operations 

The revised regulation will go into effect on January 1 of this year. It gives the more than 400 non-restricted casino operators in the state a year to establish risk assessment strategies, which will be required to be updated at least annually, and it guides operators on how they must notify any cyberattacks to state regulators.

Representatives from both the Nevada Resorts Association and the Association of Gaming Equipment Manufacturers were present at the meeting that took place on Thursday. 

According to the Las Vegas Review-Journal, which held public hearings in the autumn, none of the involved parties raised any complaints to the proposed new regulation. 

Although the vast majority of large casinos have sufficient security measures built into their data systems to avoid data breaches, resorts are sometimes the focus of hackers. 

For instance, in 2015 the property that was formerly known as the Hard Rock Hotel and is now known as the Virgin Hotels Las Vegas disclosed a data breach. 

During the seven months spanning from September 2014 to April 2015, customers were notified via email to review the statements associated with their credit cards.

Continuing to Monitor and Evaluate Potential Cybersecurity Threats

The cybersecurity best practices that the regulation deems appropriate must be developed by the casino and sportsbook operators, but the regulation offers them a lot of leeway in how they protect themselves from cyberattacks. 

After completing an initial risk assessment, each licensee must continue to monitor and evaluate potential cybersecurity threats to the operation of their business “on an ongoing basis.” Additionally, licensees are required to modify their cybersecurity best practices and risk assessments “as they deem appropriate.”

Under the new laws, licensees are required to notify the Nevada Gaming Control Board of any cyberattack that leads to a data breach within three days of the occurrence of the attack. The operator will be expected to explain the underlying cause of the cyberattack, the scope of the attack, and any actions that have been taken or are planned to be taken to prevent the occurrence of incidents similar to those that have already taken place.

Virginia Valentine, who is the president of the Nevada Resorts Association, stated that she and several of the association’s members attended previous public meetings that involved discussions on the matter, and that their comments that were made during those meetings were ultimately incorporated into the amended regulation.

According to reports from Review-Journal, even though Daron Dorsey, executive director of the Association of Gaming Equipment Manufacturers, did not address the commission in person, AGEM did send a letter to the commission on November 21 outlining eight suggested revisions to the regulation, all of which were ultimately included in the final document. The majority of the recommendations focused on elaborating on previously articulated policy.
